1. Introduction

Welcome to GIF BG. By accessing or using GIF BG at this website (the “Service”), you agree to these Terms of Service (“Terms”). Please read them before using the Service. If you do not agree, do not use the Service.

2. Service Description

GIF BG provides tools to remove backgrounds from animated GIFs. Solid-color backgrounds are processed using color-based techniques. GIFs with complex backgrounds may be processed using AI and require a signed-in account and credits. Processing limits, available features, and the credit cost for a GIF are shown by the Service before processing where applicable. GIF BG is an independent service and is not affiliated with Google, Supabase, fal.ai, or Waffo.

3. Accounts

Some features, including AI processing and credit purchases, require you to sign in with Google. You are responsible for maintaining access to your account and for activity carried out through it. Account and credit features are provided through third-party providers and may be subject to their terms.

4. User Obligations

By using the Service, you agree to:

• Use the Service in compliance with applicable laws and regulations.
• Upload only files you own or are authorized to use and process.
• Respect the intellectual property, privacy, and other rights of others.
• Not circumvent usage limits or security measures, interfere with the Service, or attempt to access another person's account or data.

5. Your Content and Results

You retain your rights to the GIFs you upload. You grant GIF BG permission to process and transmit those files as needed to provide the processing you request, including sending frames to fal.ai when AI processing is used. GIF BG does not claim ownership of your uploads or the resulting files. You are responsible for checking that you have the rights needed to use both your uploads and results.

Processing is automated. Results may contain visual artifacts, omit parts of a subject, or otherwise differ from what you expect. Review each result before relying on or sharing it.

6. Privacy and Data Protection

Our collection and use of information is described in our Privacy Policy. Uploaded GIFs are processed for your request and are not saved to an account or permanent file library. AI processing sends GIF frames to fal.ai. Account, credit, and payment event records are handled as described in the Privacy Policy.

7. Credits, Purchases, and Refunds

Solid-color background removal is free. AI processing for complex backgrounds uses credits. The cost is based on the GIF's frame count and is displayed before processing: 1 credit covers up to 30 frames, with 1 additional credit for every further 60 frames or part of 60 frames. Credit packs are one-time purchases, not subscriptions, and credits do not expire. Purchases are completed through Waffo's hosted checkout; applicable price and currency are shown at checkout.

If AI processing fails, the credits charged for that attempt are refunded to your balance. For other refund requests or billing issues, contact the Service operator using the contact details provided with your account or purchase communications. Refunds are handled in accordance with applicable law. Nothing in these Terms limits any mandatory rights you may have under applicable law.

Credits are tied to the account that purchased or received them and are not transferable. If an account is suspended during an investigation of suspected misuse, access to its credits may be temporarily restricted. Unused credits may be cancelled if an account is terminated for a material violation, where permitted by law.

8. Acceptable Use and Enforcement

You may not use the Service to process content unlawfully, infringe another person's rights, facilitate harassment or harm, or violate these Terms. We may refuse or stop processing, restrict access to content or features, or suspend or terminate an account if we reasonably believe that the use violates these Terms or applicable law, or creates a security or abuse risk. We will take action as permitted by applicable law.

9. Third-Party Services

The Service relies on third parties for sign-in, AI processing, and checkout, including Google, Supabase, fal.ai, and Waffo. Those services are subject to their own terms and privacy practices. GIF BG is not responsible for third-party services that it does not control.

10. Service Availability

We may update, suspend, or discontinue features, and the Service may be unavailable from time to time. We do not guarantee uninterrupted access, that every GIF can be processed, or that results will meet your requirements. Processing is subject to the file-size, frame-count, and image-size limits displayed by the Service.

11. Disclaimer and Limitation of Liability

To the extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties that are not expressly stated in these Terms. GIF BG is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Changes to These Terms

We may update these Terms as the Service changes. The current version and its last-updated date will be posted on this page. Where required by law, we will provide notice of material changes. Your continued use of the Service after updated Terms take effect means you accept them, to the extent permitted by law.
